TUTA Terms & Conditions

Last updated: September 2026

1. About TUTA

TUTA is a South African transport marketplace operated by Bayalink.

TUTA provides a platform that connects customers seeking passenger or goods transport with independent drivers.

TUTA provides the technology and marketplace used to facilitate these connections. Unless expressly stated otherwise, drivers using TUTA operate independently and are not employees of TUTA or Bayalink.

2. Using TUTA

Users must provide accurate information when creating and using a TUTA account.

Users are responsible for maintaining the security of their account and must not allow another person to use their account in a way that misrepresents their identity.

Users must use TUTA lawfully and must not use the platform for fraudulent, abusive, dangerous or unlawful activity.

TUTA may restrict or suspend access where reasonably necessary to protect users, the platform or comply with applicable requirements.

3. Customer Requests

Customers may use TUTA to request passenger rides or transport for goods.

Eligible drivers may submit offers in response to available requests.

Customers are responsible for selecting the driver they wish to use from the available offers.

The price agreed between the customer and driver for the transport service is separate from Driver Access fees paid to TUTA.

4. Independent Drivers

Drivers using TUTA operate independently.

A driver's access to TUTA does not create an employment relationship with TUTA or Bayalink.

Drivers are responsible for maintaining any licences, vehicle documentation, permissions or other requirements applicable to the transport services they provide.

TUTA may require drivers to provide information and documents as part of onboarding and continued platform access.

5. Driver Access

Eligible drivers must have active Driver Access where required to browse relevant transport opportunities and submit offers.

Driver Access is purchased for a specified period.

Current Driver Access prices and periods are displayed on TUTA before purchase and on the public Driver Access pricing section.

Driver Access purchases do not automatically renew.

When Driver Access expires, the driver must purchase another access period if they wish to continue using the relevant Driver Access features.

Driver Access does not guarantee any minimum number of customer requests, jobs, bookings or earnings.

6. TUTA Commission

TUTA currently takes R0 commission from individual transport jobs facilitated through the platform.

Drivers keep the fare agreed with the customer, subject to any arrangements or obligations that exist independently of TUTA.

Driver Access charges are separate from transport fares.

7. Payments

TUTA uses Yoco to process Driver Access payments.

Payment for Driver Access must be successfully completed before access is activated where payment is required.

Transport fares agreed between customers and drivers are separate from the Driver Access payment processed by TUTA.

8. Refunds and Cancellations

Driver Access purchases are generally non-refundable once the purchased access has been activated.

TUTA may review refund requests involving circumstances including duplicate payments, incorrect charges, payments made in error, or cases where purchased Driver Access could not be provided because of a TUTA technical issue.

Submitting a refund request does not guarantee that a refund will be approved.

Approved full refunds deactivate the Driver Access associated with that purchase.

Driver Access is not automatically renewed. Drivers therefore do not need to cancel a recurring subscription to prevent another Driver Access charge.

Refund, cancellation and payment dispute requests can be submitted to: support@tutahire.com

9. User Safety and Conduct

Users must treat other TUTA users respectfully and must not engage in harassment, threats, violence, fraud, discrimination or other unlawful conduct through the platform.

Users should confirm that the driver, passenger and vehicle information shown in TUTA corresponds with the person or vehicle involved in the trip where applicable.

TUTA may provide safety features designed to assist users, but these features do not constitute a guarantee that every transport service will be free from risk.

Users should contact the appropriate emergency services where immediate emergency assistance is required.

10. Account Restriction

TUTA may investigate reports of misuse, fraud, safety concerns, payment abuse or violations of these Terms.

Where reasonably necessary, TUTA may restrict, suspend or terminate access to the platform.

11. Platform Availability

TUTA aims to provide a reliable platform but does not guarantee that the platform will always be uninterrupted or error-free.

Temporary outages, maintenance, third-party service interruptions or technical problems may affect availability.

12. Limitation

To the extent permitted by applicable law, TUTA and Bayalink are not responsible for losses arising solely from the independent actions or omissions of users or drivers outside TUTA's reasonable control.

Nothing in these Terms is intended to exclude rights or protections that cannot lawfully be excluded under applicable South African law.

13. Changes to These Terms

TUTA may update these Terms as the platform, services or legal requirements change.

The current version will be published on this page with an updated revision date.
